Las presentes Condiciones Generales regulan el uso del sitio web http://www.secuoya.es (en lo sucesivo, el Portal), que el titular del Portal (1) pone a disposición de los usuarios de Internet (en lo sucesivo, el/los Usuario/s). The navigation and/or use of the Portal and its services entails the acceptance by the User, without reservations, of the General Conditions set forth herein, which the User must read each time he/she intends to use the Portal, as well as any other Particular Conditions that may be established, in order to regulate the services provided by SECUOYA and to inform the Users of the same, as well as to allow the provision of its services through the Portal. GENERAL CONDITIONS 1- Ownership of the Portal In compliance with the duty of information stipulated in article 10 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, the following data are detailed: The company that owns this Portal is SECUOYA GRUPO DE COMUNICACIÓN, S.A. (SECUOYA) with registered office in Granada, Gran Vía de Colón, No. 12 3rd Floor B, with C.I.F. No. A-18.859.520, registered in the Commercial Registry of Granada at Volume 1.384, Folio 215, Sheet – 34.791, Registration 1st. 2- Industrial and Intellectual Property 2.1 Intellectual and Industrial Property All images, elements, and contents included in the Portal, particularly the trademarks, trade names, designs or industrial models, drawings, texts, photographs, graphics, logos, icons, software, or any other signs or products susceptible to industrial and commercial use are property of SECUOYA or their respective owners, who have authorized their inclusion in the Portal, and are protected by current legislation. The access and navigation of the User through the Portal does not imply authorization or waiver, transmission and/or transfer, total or partial, of any right of SECUOYA or third parties, nor the granting of any right or expectation on them, specifically, of reproduction, distribution, public communication or transformation or exploitation on the Portal or its images, elements, and contents, except express and written authorization of SECUOYA. Therefore, the use, utilization, and/or reproduction of the same without express consent of SECUOYA is prohibited. 2.2 Responsibility for infringement SECUOYA will not be responsible for infringements of intellectual, industrial, or image property rights of third parties that may arise from the inclusion in the Portal, by the Users, of trademarks, trade names, designs or industrial models, drawings, texts, photographs, graphics, logos, icons, software, or any other signs or products susceptible to industrial and commercial use belonging to third parties who have declared themselves owners of the same when including them in the Portal. 3- SECUOYA’s Responsibility SECUOYA makes its best efforts to ensure that the contents and services included in its Portal are reliable and suitable, and declares to have adopted all necessary measures, within its possibilities and the state of technology, to guarantee the correct functioning of the Portal and avoid the existence and transmission of viruses and other components that may harm the User. The User acknowledges and accepts that the access and/or use of the Portal and its services is carried out under their entire responsibility, so any unauthorized access or use of the Portal and/or the content of the Portal is the sole responsibility of the person carrying it out, so SECUOYA will not be responsible for any consequences, damage or harm of any nature that the User may suffer as a consequence of the use of the Portal, such as errors and omissions in the contents, totality, accuracy, timeliness, lack of availability of the portal or the transmission of viruses, despite having adopted all possible technological measures to avoid it. 4- Modifications in the Portal SECUOYA reserves the right to make modifications to the Portal or any of the conditions of navigation and/or use of the Portal at any time and without prior notice or authorization of the User by publishing such modifications in the Portal with access to the Users, being able to change, delete or add both the contents and/or services that are provided through the same as well as the way in which these are presented or located on its Portal. 5- Link and hyperlink policy 5.1 Links and/or hyperlinks from the Portal In case the Portal has links and/or hyperlinks to other Internet sites, SECUOYA will not exercise any type of control over such sites and content. In no case shall SECUOYA assume any responsibility for the contents of any link belonging to a foreign portal, nor for the infringements of rights of third parties committed on such portals, nor guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, truthfulness, validity and constitutionality of any material or information contained in any of these hyperlinks or other Internet sites. Likewise, the inclusion of these external connections will not imply any type of association, merger or participation with the connected entities. 5.2. Links and/or hyperlinks to the Portal Any authorized link from third parties to the Portal must be made to its main page, expressly prohibiting deep links, framing and any other use of the web contents in favor of unauthorized third parties. No false, inaccurate or incorrect statement about SECUOYA, its partners, employees, clients or about the quality of the services it provides will be made from the page that introduces the link. In no case will it be expressed on the page where the link is located that SECUOYA has given its consent for the insertion of the link or that it otherwise sponsors, collaborates, verifies or supervises the services of the sender. The page that establishes the link must faithfully comply with the law and may not in any case have or link with its own or third-party contents that are illegal, harmful, contrary to morals and good customs or that are inappropriate and conflict with the activity of SECUOYA. 6- Acceptance of the General Conditions 6.1 General acceptance The User accepts the General Conditions established and commits to use the contents of the Portal diligently, correctly, and lawfully and will refrain from:
  • Reproducing, distributing, publicly communicating, or transforming or modifying the contents, except with the authorization of its owner.
  • Using any contents of the Portal to send advertising, communications for commercial purposes of any kind, unsolicited communications addressed to a plurality of people, or to market or disclose such information in any way.
  • Using the contents in a manner contrary to the law, public order, morals and good customs.
The User will be liable to SECUOYA or third parties for any damages that may be caused as a result of non-compliance with such obligations. 6.2 Rules of conduct for Chats, Blogs, and Forums of SECUOYA. The User undertakes to use the Chat, blog, and forum services of the Portal in accordance with the law, these General Conditions of use of the Portal, as well as with the law, morality and good customs generally accepted and public order. SECUOYA informs you that the usernames (“Nick”) are freely chosen by each User and, therefore, does not guarantee that the Nicks correspond with the true identity of the people who use them. SECUOYA is not responsible for the opinions, information, or contents transmitted by users through the Services. SECUOYA does not control the use that users make of the Services, so the messages or contents published are the exclusive responsibility of the User, who will respond for damages of all kinds that SECUOYA may suffer as a result of non-compliance with these General Conditions or the law. SECUOYA reserves the right to withdraw at any time, and at its discretion, messages that are contrary to the General Conditions of use of the Portal or to current legislation. 7- Applicable legislation and jurisdiction The applicable legislation governing the relations between the User and the owner of the Portal will be the Spanish Legal System. For the resolution of any controversy that may arise, SECUOYA and the User voluntarily submit, expressly waiving any other jurisdiction that may correspond to them, to the Courts and Tribunals of Madrid.
